I have had a couple of games were an assault has been made against a Gruntz squad in a building. Very few or no casualties have been caused by either side. This means the result is a draw and both sides have to take a mental test. The way the dice fell the defender failed the test and the attacker made it. It seems strange the defender is equally likely to leave a defended building as the attacker is to take it (if both have the same mental stat) in the event of a draw. I would suggest allowing the defender to modify their roll by a minus equal to the cover bonus solely in the event of a draw.

Well, just my thoughts on it, if I'm inside of a building (well defended) and an attack comes in and almost takes me out, but we just barely scrape by I might be looking for a new residence too. Especially since the building doesn't seem to be providing adequate cover.
Just one way to look at what the rules are trying to represent. I can see your point as well though.

First question for me would be to find out what the building type was. If it has full height walls with just windows and perhaps a small door it might be difficult to get the assaulting unit up and engaged, in which case having a squad member on each side of a wall I can understand why no damage was done. However if it is a low walled building with lots of open space to engage over it would certainly be easier to engage and get figures base to base so they can assault.
What do your buildings look like? Are they open or do they have just the one door? Were you filing the assaulting squad into the building via a door?
